Of the many and interesting questions addressed by Orunesu, Rodríguez, and Sucar, in their work, I am going to deal with what I consider to be their core thesis: unconstitutionality and derogation are different things. I must state, right from the beginning, my basic agreement with such a statement, although in these pages I hope to contribute with some additional considerations to those made by the authors and to express some small discrepancies.
