In this paper I will try to make some conceptual clarifications regarding the notion of “unconstitutionality”, and then offer various reconstructions of the criterion of legality that each model of legal order presupposes. Finally, a question will be raised that allows us to highlight a certain relationship between the purified legal order and the presuppositions of inclusive positivism.
