Abstract

Why using comparative law in legal argumentation? What are or should be the criteria to select the law under comparison? Is it necessary that the I/A Court HR tackles the methodological question regarding the argument of comparative law? More specifically, what is the attitude that the I/A Court HR has towards the argument of comparative law? Silence? Refusal? Openness? Apparently, it is not of refusal. It is of openness, however: Is it one of inspiration, reception or explicit dialogue? My hypothesis is that the argument of comparative law used by the I/A Court HR embeds strong tensions.
