Abstract

This paper will show that Juan Pablo Alonso's specification of the systems of the judge and the citizen in "criminal rules and conflict of duties" is inadequate (section II). Then, it will be shown that his application of the dogmatic institution of the collision of duties to the concrete case is also inadequate (section III). The paper concludes with a brief final reflection (section IV).
