Abstract

In this article I will try to show that the notion of "Kelsenian derivation", on which the whole of Juan Pablo Alonso's work is based, is untenable and that - consequently - the problem posed in "Criminal Law Norms and Conflict of Duties" dissolves ab initio as a false problem.
