Duarte’s balancing: Comments and Doubts

In this commentary, David Duarte’s proposal on the positivist weight formula is examined. The text is structured in two parts. The first synthesizes Duarte’s critiques of Robert Alexy’s weight formula and his proposed revisions. The second part offers comments and doubts centered on three axes: (i) the justification of abstract weight in the weight formula and its link with moral arguments; (ii) the implications of the eliminative character of substantive law for the application of formal principles; and (iii) the risks of fragmenting empirical and normative premises.
