Abstract

The main objectives of this introduction are threefold: (i) to
present David Duarte’s text on the “positivist weight‐formula” and to summarize
the main points of critique developed by his commentators; (ii) to
outline the trajectory of the Lisbon Group (the so-called “Lisbon Legal
Theory”) and the role played by David Duarte in the setting up and consolidation
of this academic space; and (iii) to point out my own four criticisms
of Duarte’s proposal.
