This issue offers a dialogue between criminal law and legal theory. In particular, the debate shows how the explicit adoption of a certain conceptual instrument from the theory of law, namely, a particular theory of norms, has important consequences for the understanding of our punitive practices and for shedding light on fundamental questions of Criminal Law theory that are still controversial.
