Resumen

En este trabajo se evalúa la institución de la herencia desde un ideal meritocrático y se concluye que la herencia se opone a la meritocracia en dos sentidos. Primero, las recepciones hereditarias, al ser inmerecidas, no respetan un criterio de distribución basado en el esfuerzo y las capacidades personales. Segundo, las transmisiones hereditarias tienden a generar concentraciones de riqueza que amenazan la igualdad de oportunidades requerida por la meritocracia. Por lo tanto, un diseño legal meritocrático debería abolir o limitar significativamente las recepciones hereditarias.
